Pos payments: the Meloni government’s proposal on fines was rejected


Most payments under 60 euros are made by card or debit card, then via Pos. The Court of Auditors has rejected the stop on fines for Pos payments under 60 euros. It goes against the projects and commitments of the Pnrr. The raising of the limit for cash payments to 5 thousand euros and the tax amnesty also go against the Pnrr. 


It must be said that the majority of merchants concentrate on the weight of the costs associated with the POS. The convenience of the POS depends on various factors such as the number of transactions, the cost of the offer and the type of clientele. By now, electronic payment methods are the order of the day among young people and adults. Here, faced with the refusal to pay by card, perhaps one will choose not to return to that commercial establishment. According to statistics, Italian merchants pay 0.7%, less than the Netherlands (1.4%), Germany (1.3%) or the United Kingdom (0.8%). Here are the news that the 2023 budget law wants to introduce on Pos payments. 


It is important to achieve significant improvements in terms of tax consistency, placing effective action to contain tax evasion at the center of public objectiveswhich, despite the results achieved, remains of considerable size. As repeatedly underlined by the Court, to do this it is necessary to make full use of the various prevention and contrast measures, which can contribute to raising the levels of fiscal loyalty, favoring, through the use of technologies, the spontaneous emergence of taxable bases and supporting the necessary control action of the Tax Administration; this also through the systematic use of financial data and, last but not least, an effective collection activity. Some of the measures of the maneuver that interrupt a path undertaken for traceability do not seem to go in this directionof payments, which expand the area of ​​revenues subject to the flat-rate regime or which propose favorable regimes which, if they allow for an increase in immediate revenue, mortgage future revenues.

Reducing the use of cash that does not have a traceable transfer enhances the control action and makes criminal activities more complicated to implement. Instead, the more widespread use of electronic payments gives consumers freedom of choice, but increases the risk of tax evasion. Furthermore, electronic payments represent a greater burden than the use of cash. In addition, raising the payment cap and not sanctioning refusals to accept electronic payments of a certain amount may be inconsistent. Yes, inconsistent with the envisaged fight against tax evasion, that’s why they go against the commitments of the Pnrr and to the disadvantage of the State.
